I. Acceptance of Terms and Conditions
By accessing and using the portal Test results (referred to as “SynevoWeb” or WebResults) of Synevo Romania S.R.L. (hereinafter “Synevo”) you confirm the fact that you agree to comply with the below terms and conditions (hereinafter referred to as “Terms and Conditions”). We recommend a careful reading thereof. These Terms and Conditions may be revised at intervals as decided by the administrator, without any obligation of the latter to send a notification to the SynevoWeb users. By continuing to use the SynevoWeb after any change of the Terms and Conditions, you agree to the operated changes. If you do not agree with the Terms and Conditions of Use, you are kindly requested not to use SynevoWeb. By accepting these Terms and Conditions, you express your agreement concerning the conditions for the use of SynevoWeb and of the information available therein. These Terms and Conditions set up the minimum mandatory rules to be observed, the legal terms and conditions under which you may use SynevoWeb. They shall be supplemented by the legal regulations in force, Access to SynevoWeb, any adjacent services and the SynevoWeb contents shall be provided to the users free of charge, on the condition that you accept the provisions of these Terms and Conditions in full, without reserve. If these Terms and Conditions are not accepted, you are unable to use SynevoWeb, or the services operated through it. Any use of SynevoWeb irrevocably represents your express acceptance of these Terms and Conditions in full, as well as of any review/amendment that may be incurred to such in the future, without any prior notification in this regard. We recommend that the users periodically visit this page in order to acknowledge and read the Terms and Conditions, to the purpose of ensuring the informed use of any services provided within SynevoWeb and in compliance with the obligations of any person who is interested in the SynevoWeb functionalities and options as a user.
The SynevoWeb users may be Physicians, Clients (legal entities), as well as Patients (natural person).

II. About SynevoWeb
SynevoWeb provides access to information on diagnostic services (test results) carried out by Synevo. SynevoWeb provides differentiated information according to the mode in which the user accesses / would like to access the results of tests carried out in the Synevo laboratories, through an Individual Account based on an Identity Number (CNP), through an account based on a Test Request, or through a Physician Account, respectively a Client Account, under the conditions set up below, in Section III of these Terms and Conditions.

III.SynevoWeb Access
According to your user profile/ category, you have to access the correct category in order to be able to connect on SynevoWeb.

1. Physician Access
The purpose of SynevoWeb is to provide access to your personal data, in your capacity as Physician, to the data of the Patients correlated with your license number, as well as to the test results and to the history of test reports for each patient registered in the Synevo system as correlated with your license number (existing on the test referral), according to your patient’s request.

2. Client Access (legal entity)
The aim of SynevoWeb is to provide to you, in your capacity as Synevo Client, access to the test results and to the history of test reports of every patient from the Synevo system registered based on the service agreement concluded between the parties.

3. Patient Access by using an Individual Account based on the Personal Identity Number (CNP)
The aim of SynevoWeb is to provide access to your personal data, in your capacity as Patient, as well as to the test reports and to the entire test reports history related to the tests carried out in Synevo Laboratories, for the tests paid by the Patient or for the test paid by the Synevo partners, according to the Agreements signed with these partners. In order to be granted access to this Account type, you need to register and to request access in one of the Synevo blood drawing points, by submitting all the information needed in view of issuing and filling in the appropriate form provided upon request within the Synevo sampling facilities.
After creating the Individual Account based on the Identity Number, all test results based on the tests paid by the Patient or for the test paid by the Synevo partners, according to the Agreements signed with these partners shall be available in electronic format by accessing the web account.

4. Patient Access by using an Account based on a Test Request
The aim of the Account based on a Test Request within SynevoWeb is to provide access only to the results bulletin related to the tests for which the request was issued, together with the necessary credentials (username and password). The Account access data is published in the Test Request at the ”Cont online - rezultate cerere” section. This type of Account does not provide access to the history of test reports previously issued by Synevo for you, nor to your personal data. We recommend that you do not disclose the password for accessing your account to other persons. We point out the fact that you are fully liable for any prejudice which you or a third party may suffer as a result of a third party accessing your account.
Note: All users who request an Individual Account based on the Identity Number at the Synevo centers and who receive access to this type of account shall always be able to view the results of the tests requested by accessing the SynevoWeb.
Note: In case the requested tests are subcontracted to laboratories from outside Romania, we inform you that for objective reasons, independent of Synevo's action, namely delays of logistics/ transport service providers, there is a possibility that the test results will be delivered after the communicated deadlines or a new blood sample may be necessary if the samples lose their stability. In this case, you acknowledge and expressly accept that Synevo Romania is in no way responsible for all and any of the direct and/ or indirect damages that could be determined by/ would be in connection to the above.
For details regarding the security of information within the account, please read the mentions under chapter V below. It shall be forbidden to copy, publish, and distribute the information submitted by SynevoWeb for purpose other than informing the user on his/her medical history. Any distribution of information from SynevoWeb by you or by a third party shall be exclusively your responsibility. The SynevoWeb Administrator is entitled to suspend the right of access at any point if he/she determines that, due to the manner in which SynevoWeb was used, your account was accessed by third parties or if there are suspicions that you infringed upon the Terms and Conditions of Use. Synevo shall, at any time and in a discretionary manner, have the right to amend SynevoWeb or to interrupt its operation, temporarily or permanently, without your prior notice or approval and without being liable to you or to any other person for the caused damages or incurred discomfort. Synevo is the sole owner of SynevoWeb.

1. Physician Access

IV. Partial results
If the request to perform several medical tests is registered in the system, their results shall be available in SynevoWeb in real-time, as the requested tests are carried out in the laboratory and the results are issued. Such partial results shall be flagged as such within SynevoWeb, without any notification of availability of the partial results. Upon final validation, certain results may be amended, as a result of the correlations made by the Laboratory Physician, without distinctly flagging any potential operated amendments within SynevoWeb. To request additional explanations or additional information on the possible changes or amendments referred to within this article, the user shall have the possibility to address a Synevo representative.

V. Security of information within the account
You shall have exclusive liability concerning the confidentiality of your user name and password, as well as concerning your medical data available on SynevoWeb. Please note that you are fully liable if the use of your Account is achieved by a third party, whether or not your agreement for such use exists. You are under the obligation to have the SynevoWeb Administrator informed whenever you find that an unauthorized use of your account occurred. At the same time, you are under the obligation to log out from your account when you wish to leave SynevoWeb. Synevo shall not be liable in any way for any damages caused to you or a third party as a result of your failure to comply with this provision. Synevo, as owner of SynevoWeb, has taken all reasonable action to maintain confidentiality of the information presented on SynevoWeb. Synevo shall not be held liable for the security of data, as there are no technical means guaranteeing the impossibility to ”break” SynevoWeb.

VI. Responsibilities of the user
Upon accepting these Terms and Conditions, we hereby inform you that you have acknowledged and you fully agree with the fact that Synevo is not and shall not be held liable for any direct, indirect, accidental or special damages which may result from:
- A) the use or impossibility to use the SynevoWeb services due to causes outside the control of Synevo or of the SynevoWeb administrator;
- B) losing the access data for reasons which can be attributed to you (user name and password);
- C) any statements or actions made by third parties concerning the SynevoWeb services, for which Synevo has no obligation to be held liable, under the law;
- D) the deletion of all or of part of the personal data on SynevoWeb;
- E) the determination of diagnostics or treatments by you or by a physician, based on the information included in SynevoWeb;
- F) any other issue related to the services and information submitted through SynevoWeb, for which Synevo is not held liable under the law.
Your individual account based on the Identity Number (CNP)/Physician account/Client account on SynevoWeb shall be closed based on an information submitted in writing to the Data Protection Officer by using the contact address datepersonale@synevo.ro, within one month from receipt of the information from the Data Protection Officer, and this period may be extended by two further months according to the law. As a result of closing the SynevoWeb Account, your access to the SynevoWeb services shall no longer be permitted.
If access to the system is disabled, the user is entitled to reactivate access by means of the re-registration operation carried out in any Synevo center. At the same time, in case the password is lost, the user may recover the password by using the “I forgot my password” option available in the log-in panel, as well as by any request submitted to this purpose in any Synevo center.
Your account within SynevoWeb can also be closed and your access can be blocked in case the SynevoWeb administrator determines your failure to comply with any of the provisions of these Terms and Conditions. If such a situation occurs, any access to the system shall be permanently blocked, and the user shall be informed by e-mail concerning such incident.

VII. General
If, by using the recognized procedural modalities, one or several clauses of these Terms and Conditions is/are canceled or declared null and void by a competent court of law, the effects of such nullity shall under no circumstances affect the validity of the remaining provisions which, based on their compliance with the legal regulations, shall remain fully applicable in the future. These Terms and Conditions represent the only agreement concluded between you and Synevo in relation to the SynevoWeb usage actions and the accessing of the information available on it, having precedence upon any prior agreement on this matter. Synevo is the only one entitled to amend the conditions, without sending any notification and without needing to previously request your acceptance. Any amendment to the conditions shall be immediately implemented in the SynevoWeb and it shall give you the right to find out the latest version of such conditions by merely accessing these conditions.
